An Update from Our Attorney July 1, 2011 -

 

Today was a great day for the North Shore community and for Save NE Tacoma! Pierce County Superior Court Judge Katherine Stolz announced her decision today in the appeal of North Shore Golf Associates and Northshore Investors.  NSGA and NSI had asked the court to overturn the decisions of the City of Tacoma Hearing Examiner and City Council and order the City to issue the approvals allowing for the redevelopment of the North Shore golf course. Judge Stolz affirmed the City’s actions on all counts and refused to alter the City’s decisions in any way. Judge Stolz emphasized that it was the golf course owners who had originally approached the city and offered the golf course as the open space for the North Shore development. The court also declined our request to extend the ruling to cover several  additional alternative justifications for the City’s decisions. That is of little consequence. This is a resounding victory!

 

The attorneys will now attempt to agree on the wording of a written order reflecting the judge’s ruling. If the attorneys agree on the language of the order, each of us will sign the document and forward to Judge Stolz for signature. Given that the decision is to affirm the City’s decisions on all counts, there should be little room for disagreement. If the attorneys cannot agree on the language of the order, Judge Stolz will make time available on July 22 for the attorneys to present their respective orders. Once an order is signed and entered, NSGA and NSI will have 30 days to appeal Judge Stolz’s ruling to the Court of Appeals.

"A low-density residential district with limited commercial and multifamily development, focusing on the automobile for transportation, with access to recreational activities, open space as well as basic public and private facilities and services."

The neighborhood action strategy is designed to maintain and enhance this area vision through public and private actions that address community needs and concerns. The strategy emphasizes:

(a) the preservation of remaining open space, steep slopes and other natural areas;

(b) the development or improvement of arterial streets along with other means of circulation within Northeast Tacoma and in accessing other areas; and

(c) the development or expansion of public facilities and services to meet the community’s growing population.
